Microsoft Files Counterclaims Against Sun

(February 28, 2003) - Microsoft has filed a 51-page brief in the U.S. District Court for the District of Maryland, responding to the claims made in Sun’s August 2002 complaint against Microsoft. The brief includes several counterclaims against Sun, including charges of breach of contract, bad faith dealings, unfair competition, and violations of California state business and professional codes.

The brief says that a prior lawsuit settlement resulted in an agreement that Microsoft would distribute its version of the JVM through 2008, but that Sun's recent court actions have broken that contract and prevented Microsoft from using its Java license. The brief does not seek a specified dollar amount, leaving that matter to be settled in the trial.

"We are conducting a thorough review of the document," said Lee Patch, vice president, legal affairs, Sun Microsystems, Inc., regarding the brief. "Microsoft's counterclaims allege that it was Sun that breached the January 23, 2001 Settlement Agreement (this is the agreement that was considered already by Judge Motz in the Preliminary Injunction hearing). We look forward to bringing evidence to prove the merit of all of our claims and answer Microsoft's counterclaims at trial," he continued.

This is exactly why I prefer not to use Web Application development and deployment products from these vendors. Instead of focusing on better technology collaboration they are wasting time and money on disputes.
